Properties with a pool installed before November 1, 2010 must comply by September 30, 2027. Those with a more recent pool must already meet the standards. This covers in-ground, semi in-ground and above-ground pools -- but not spas under 2,000 litres, natural water basins or water gardens.
In-ground or semi in-ground pool: a fence is mandatory, period.
Above-ground pool: if the walls are 1.2 m (4 feet) or higher, a fence is not required as long as access is secured by a lockable ladder or enclosed platform. If the walls are under 1.2 m, a fence is mandatory.
Inflatable or temporary pool: if the walls are 1.4 m or higher, the fence is optional as long as access is controlled. Below 1.4 m, a fence is mandatory.
Minimum height: 1.2 m (48 inches).
Anti-climb design -- no horizontal bars that form a ladder.
Vertical spacing between bars: maximum 10 cm (4 inches).
Ground clearance: maximum 10 cm.
Chain link: openings of maximum 3 cm, or insert slats.

Automatic closing and locking.
Latch positioned on the pool side, in the upper portion.
If the latch is on the outside: at a minimum height of 1.5 m (5 feet).
Each municipality can impose stricter rules than the province. Before starting work, we recommend contacting your city's urban planning department to check local requirements and obtain the necessary permit. Non-compliance can result in fines from $500 to over $1,000.
